In part 1 of this blog, I discussed PA and NJ sports and recreational accident cases, and why I have a unique view of these types of cases because of my background.
In this part of the blog, I will talk about 2 challenges all sports and recreational accident cases have in common.
The first challenge is a mix of legal and factual challenges. All of these activities, i.e., playing sports, working out, etc., involve some degree of risk that is inherent in the activity.
The law recognizes that and has created some legal doctrines that really present a challenge to successfully pursue sports and recreational activity accident cases.
I have significant experience in dealing with these legal doctrines and overcoming these challenges.
The second challenge that sports and recreational activity accident cases often present deals with the injury or the damages portion of the case.
Sometimes these sports and recreational accidents result in very severe injuries. I have represented individuals with the most serious types of injuries in these cases, i.e., quadriplegia, brain damage, etc.
In other cases, the real injury or the real damage in the case is the inability of the injured person to continue with the activity that they were doing when they got hurt and to continue living a healthy, active, athletic lifestyle. To some people, that is not much of a loss, and it’s a genuine challenge to communicate and explain what it means to someone who has lived a very healthy, active, athletic lifestyle who can no longer do that.
I have worked very closely with my clients to develop that evidence, communicate that evidence and turn that evidence into a fair and full economic recovery in their cases.
