A go to meal that many parents make for their children is macaroni and cheese. It is a meal that most kids, even the pickiest eaters, will eat. However, one of the most popular brands of macaroni and cheese was recently recalled. Parents need to make sure that they are not serving the recalled macaroni and cheese to their children.
Earlier this week, Kraft Foods recalled about 242,000 cases of original flavor of Kraft Macaroni & Cheese. That is about 6.5 million boxes of macaroni and cheese. They are being recalled because some of the boxes contain small pieces of metal.
The boxes were sold throughout the United States and have “best when used by” dates ranging from September 18, 2015 to October 11, 2015. The boxes are also marked with the code “C2.”
Affected products include 7.25-ounce boxes as well as 3-pack boxes, 4-pack and 5-pack wrapped boxes of 7.25-ounce servings of the family favorite.
Kraft Foods Group Inc. reported that it was aware of 8 incidents of consumers finding metal in the boxes, but fortunately, there haven’t been reports of any injuries thus far.
Consumers’ Legal Rights
If consumers are injured as a result of ingesting the metal in the macaroni and cheese, they may have legal rights against the food manufacturer. They may be able to recover financial compensation from the food manufacturer by filing a personal injury lawsuit because the recalled food caused an injury to the consumers. This type of an injury lawsuit is referred to as a products liability lawsuit.
There are three different theories of liability against the manufacturer in a Pennsylvania and New Jersey dangerous products lawsuit:
In the case of a recalled food product, the theory of liability is that the food was made defectively. Somehow during the manufacturing process, metal got in the boxes of macaroni and cheese.
If the macaroni and cheese was in fact manufactured defectively, injured consumers may recover the following damages:
