PA Dog Bites & Attacks - Postal Carriers Are Often Victims Of Dog Attacks

As I was driving home the other day, I saw a mailman delivering a package to one of my neighbors down the street.  The mailman got out of his vehicle and was in the process of getting the package out of the vehicle.  At that moment, my neighbor opened his door, and his dog burst out the front door, charging toward the mailman.  The dog was little in size and kept trying to jump on the mailman.  Though the dog didn't cause any harm to the mailman, it may have if the dog was much bigger and/or aggressive.

If the dog attacked, bit and injured the mailman after escaping from the house, my neighbor as the dog owner may be held responsible for the mailman's injuries.  The mailman may file a PA dog attack lawsuit against my neighbor and recover for his injuries and damages. 

Under PA law, dogs have to be under proper and adequate control by their owners.  The purpose of this law is to prevent dogs from running at large to protect the public's health and safety.  The dog does not have to actually bite a victim for the owner to be responsible.

For instance, if the neighbor's dog ran out of the house, knocked over the mail carrier who fractured his ankle as a result of his fall, the dog owner may held responsible because he did not have his dog under proper and adequate control.

Many Pennsylvania dog owners do not have their dogs under adequate control when they are walking their dogs outside or even when the dogs are at home.  For instance, when the door bell rings, a dog may run to the door and start to act aggressively.  In this case, the dog owner should put the dog in a separate room before opening the door.  Trying to block the dog from getting out the door does not work.  In all likelihood, the dog will burst through the door to get to the stranger on the other side.  If the dog bites and injures the person at the door, the owner may be held responsible.  Dog owners need to keep this in mind during this holiday season as many homeowners who have dogs will be receiving packages from mail carriers.

According to the Postal Service, 5,581 postal employees were attacked by dogs in 2013.  Earlier this year, the Postal Service released top dog attack city rankings.  Two cities in Pennsylvania made the list.  Philadelphia is ranked at #15, and Pittsburgh is ranked at #25 on the list (see chart below).
