Rear-end car or truck accidents are one of the most common types of motor vehicle accidents in Pennsylvania. My client was traveling on Interstate 95 in Bensalem Township, Pennsylvania. Suddenly, my client's car was rear-ended by another driver. As a result, my client lost control of her car and ended up in the shoulder when she hit the guardrail. Fortunately, my client did not sustain a second impact from other vehicles traveling on the highway.
Though my client did not sustain any serious orthopedic injuries, her injuries were significant. My client was pregnant at the time of the accident. Immediately after the accident, she began to experience abdominal tightness and premature contractions. The police arrived at the scene, and the other driver was cited for "Driving Too Fast for Conditions."
My client was transported to a hospital to insure the health of her unborn child. She was discharged with instructions to follow up with her obstetrician.
The next morning, my client experienced premature contractions again and went back to the emergency room. She was admitted to the hospital with the principal diagnosis of "Threatened Premature Labor."
My client was put on bed rest for the remainder of her pregnancy by her obstetrician and had to follow up with her doctor every week. She spent 2 months on complete bed rest, and as a result, had no choice but to stop working.
My client received PIP coverage for medical bills which were paid by her own car insurance company. More importantly, her pain and suffering damages were quite significant despite the fact that her total economic losses, i.e., out of pocket expenses for medical treatment co-pays, were relatively minimal.
She was forced to face and cope with the very real fact that she had nearly lost her child as a result of the car accident. She was fraught with constant worry throughout the remainder of her pregnancy. In addition, my client was a mother to a 10 year old girl. She could not care for her daughter for 2 months. If she was not rear-ended on the highway, she would not have had been on complete bed rest for the remainder of her pregnancy.
We were able to successfully settle this case against the driver who rear-ended my client for his maximum liability coverage.
