Though many rear-end car and truck accidents in Pennsylvania result in fender benders, rear-end accidents can also result in serious injuries to the injured motorists. We recently settled a case for our client who was seriously injured in a PA rear-end car accident.
On the morning of the accident, our client was driving to work at a local university in Pennsylvania. Our client was stopped in traffic when a pickup truck suddenly slammed into her from behind. The driver of the pickup truck was distracted. He did not realize that the traffic ahead had come to a complete stop because he reached down to pick up something off the floor of his truck and took his eyes off the road.
In this case, there was no doubt that the pickup driver was at fault. He was not paying attention to the road. Our client was an innocent victim of the accident.
Immediately after the accident, our client felt pain in her shoulder, back, neck and arm. She saw her primary doctor complaining of pain. She also felt as though something was stuck under her shoulder blade. She experienced burning running down her right arm.
An MRI revealed that she had two prominent cervical (neck) disc herniations with right sided nerve root compression. As a result, she needed to have surgery to remove the discs in order to decrease the chance of permanent nerve damage in her arm. Our client ended up undergoing a two-level discectomy and fusion at the Hospital of the University of Pennsylvania.
As a result of her injuries, our client missed 14 months of work as a computer systems manager.
We filed a lawsuit against the driver. After conducting discovery, i.e., exchanging documents between the parties, depositions, etc., we agreed to try to settle the case in a mediation. We were able to settle the case and obtained a confidential six-figure settlement for our client.
· $2,7000,000 settlement for a hit and run accident
· $1,750,000 arbitration award for an underinsured motorist case
· $1,000,000 settlement for a head-on collision with dump truck
