Our client was a retired gentleman who worked part-time as a helper at a horse farm. A feed supply company delivered a ton of oats to the farm. The oats were blown from the tank truck into a grain bin, which is a small silo attached to a barn. There was a hole in the hose and the oats were sprayed over the ground and onto the pitched roof of the barn. The deliveryman took a wet-dry vacuum onto the roof of the barn and began vacuuming up the oats. As the vacuum became full, it became top heavy, and it eventually tipped over and fell off the roof. It struck our client in the head and shoulder, causing a mild traumatic brain injury and torn rotator cuff.
This case was filed in the Bucks County Court of Common Pleas, and was settled for $700,000 prior to trial.
