Our client was employed as a machine operator at the Kimberly Clark plant in Chester, Pennsylvania. He suffered arm and hand injuries when his arm was drawn into the machine while he was clearing a jam. This particular machine had been re-engineered by the original manufacturer and a consulting engineering firm prior to the accident. We alleged that the original design of the machine was defective, and that the re-engineering had been done negligently for not incorporating guards, interlocks and/or emergency stops.
Our client was the sole wage earner in his family. He was a husband and a father of three young children, who was unable to return to work as a result of his injuries.
We were able to resolve the case in mediation prior to trial in a multi-million dollar settlement.
