This was a wrongful death case in which our client’s husband was shot to death after reporting an alleged sexual assault to the police. The man who committed the sexual assault is the individual who ended up shooting our client’s husband.
We sued the shooter’s wife, claiming that she was negligent, due to the fact that she had some prior knowledge that her husband intended to harm our client’s husband, and that she therefore had a duty to warn or otherwise take some steps to prevent the assault.
The decedent in this case was the father of 10 children, and was the only wage earner in the family. His wife was pregnant with the couple’s 11th child at the time of the shooting. We relied on a very rarely-used legal theory against the shooter’s wife to make out a negligence case and therefore prevent the wife’s homeowner’s insurance company from avoiding covering the claim.
We were able to obtain $2.1 million dollar settlement in this case, with the shooter’s wife’s homeowner’s insurance company paying the full limit of their homeowner’s coverage.
