How much time do I have to sue? How long will the case take before it is settled or goes to trial?

 

A: Both in Pennsylvania and New Jersey, there is typically a two year Statute of Limitations for personal injury cases. This means that the lawsuit must be filed within two years of the accident date. This is the general rule, and a different Statute of Limitations applies to certain types of cases. The length of time it takes for a case to settle or go to trial depends on may different factors, and there is really no one answer to this question. One of the mort important factors in determining the length of time a case takes to resolve is the venue in which the case is filed. The various counties through Pennsylvania and New Jersey have different methods and systems for moving the cases through the Courts, and the length of time can vary significantly from county to county.
