I fell over a crumpled mat at a supermarket and fractured my wrist. Can I sue the grocery store?

 

A:

Yes, if we can prove that the mat was unsafe and that the supermarket had notice of the unsafe condition.  We really need to know the specific facts of your fall.  In determining liability in PA trip and fall accident cases like this, the facts have to be carefully evaluated.  For example, if the mat was put down crumpled, without laying it flat on the floor, by the supermarket employees the day before your fall, you may be able to sue the supermarket.  However, if the employees put the mat down flat, and the crumple was caused by a customer's shopping cart minutes before your fall, it would be difficult to sue the supermarket for your injuries.  Therefore, determining the length of time the crumple was in the mat is an important factor.
