I tripped and fell into a pothole that was at the supermarket parking lot as I was pushing my cart to the car. I broke my wrist and seriously hurt my shoulder in the fall and I want to know if I have a case against the supermarket.

A:

I would need to know more facts about the pothole in terms of its size and whether there were warning signs around the pothole.  If there were no cones or warnings signs by the pothole, you would be able to bring a lawsuit against the supermarket.

Public places which are frequently visited by patrons or customers, such as supermarkets, have a duty to protect their customers from dangerous conditions.  In this case, the supermarket had the duty to maintain and or repair the parking lot in a reasonably safe condition.

In addition, if the supermarket's parking lot is managed and/or maintained by another party, then you would be able to bring a lawsuit against that party as well.

Again, I need more information about your fall.  Therefore, it is important that you speak to our Pennsylvania or New Jersey trip and fall accident lawyers to discuss your potential case.  Our experienced attorneys would also be able to tell you other parties that may be responsible for your injuries.

Feel free to contact us for a free, no obligation consultation, and we can answer any questions you may have about your fall. 877.944.8396
