I was hit and injured by a car while crossing the street; however, I elected limited tort on my car insurance policy. Are my rights to suerestricted by limited tort?


A: No.  In Pa, a pedestrian's right of recovery is not restricted by pedestrian's election of limited tort on his/her car insurance policy.  See L.S. v.  Eschbach, 583 Pa. 47 (2005). Therefore, you can sue the driver for the injuries you sustained in the accident.  The tort option only applies when a person is occupying a motor vehicle when injured.
