I was injured while using a tool that wasn't mine, I had borrowed it from a friend. Can I still make a claim against the company that made the tool?


A: Yes. You do not have to own the product that caused your injury to bring a products liability claim. The focus in a products liability claim is on the product itself and not on who owned it, bought it or actually paid for it. Rather, the real question is whether the product was defective and whether your injury was caused by that defect. We will ask your friend to lend us or sell us the tool so we can, perhaps with the help of an engineer, determine if the tool was designed or manufactured defectively and whether it contained proper warnings and instructions. You do not have to be the original or current owner of the product.
