My husband races on a motocross course as a hobby. He had a terrible accident and is now a quadriplegic. His friends said that there was something wrong with the course which caused the accident. Can he sue the motocross course?

 

A:

Yes, if a thorough investigation reveals that the course was set up negligently by the motocross track operator or if course management caused your husband to get injured some other way. 

The investigation needs to be thorough because we would need to overcome the legal doctrine that sports and recreational activities, such as motocross racing, involve some degree of risk that is inherent in the activity.  However, just because a risk is inherent in the activity doesn’t mean that the establishment was not responsible in causing the accident by the way the course was set up or managed.
