My son was attacked by my neighbor's pit bull and my neighbor says her dog never attacked anyone before. My son is permanently scarred. Can we bring a case against my neighbor?

A:

Yes.  In New Jersey, a dog owner is strictly liable for a victim's injuries and damages caused by his or her dog.   Even though your neighbor said that the pit bull never attacked anyone before or that it was not previously aggressive, it does not matter in terms of your neighbor's liability. Your neighbor can be held liable for your son's medical bills and pain.

You should talk to an experienced New Jersey dog bite lawyer to discuss your legal rights.  Feel free to contact us with any other questions or concerns you may have @ 877.944.8396.
