Our little boy got hurt by a toy. We did not actually see it happen, butwe now think that this toy is dangerous. Can we sue the toymaker if no one actually saw our child get hurt?

 

A: Yes. You can bring a products liability case on behalf of your minor child even if you did not see the actual injury. We still have to prove that the product was defective, that is, unreasonably dangerous and that the defect is what caused the injury. However, we may be able to prove these points without an eyewitness depending on the nature of the product, the injury and perhaps an engineering analysis.
