I was at my gym playing basketball when I slipped on some water on the court and fractured my ankle. What can I do?



You may be able to bring a PA slip and fall accident lawsuit against the gym.  In Pennsylvania, businesses open to the public, such as the gym, have a duty to keep their members/patrons safe from unreasonably dangerous conditions on the premises.

In order to prevail in your claim, we need to prove that the gym had notice, either actual or constructive, of the puddle of water on the floor.

If several hours prior to your slip and fall accident, another member of the gym informed management that there was excess water on the court, then the gym had actual notice of the dangerous condition.  Therefore, because the gym failed to clean up the water or put cones around it to warn members of the water, the gym may be liable for your injuries.

If the gym didn’t have actual notice, you may still prevail if the gym had constructive notice.  For example, if it was the gym’s policy to inspect and maintain the basketball court every day prior to members using it but did not do so on the day you fell, the gym may be liable for your injuries.  The reason is if the gym inspected the basketball court like it was supposed to according to its own polices, then it would have discovered the puddle of water and cleaned it up.  Because it did not comply with its own procedures, you slipped and fell on the court.

A puddle of water should not accumulate on a basketball court.  This obviously poses as a dangerous slipping hazard for members playing basketball on the court.  The area with the water should have had warning cones around it informing players not to use the court.
