Slip and Fall Accident on a Speed Bump (Part A) - Who's Responsible?

Speed bumps are often used as a safety feature to force drivers to slow down when driving; however, they can also be a dangerous condition and cause injuries to pedestrians.

Some public places we see speed bumps are:

  • parking lots of grocery stores,
  • parking lots and driveways of schools,
  • parking lots of malls, or
  • parking lots of public amusement parks.

These places often have high pedestrian traffic walking from the parking lot to/from these public establishments. 

Who Is Responsible For Injuries Sustained After Slipping On A Speed Bump?

In slip and fall accidents caused by a dangerous speed bump, there may be many parties legally responsible:

  • the public establishment, i.e. grocery store, restaurant, etc;
  • the company that installed the speed bump;
  • the company that maintains the speed bump; or
  • the company that maintains the parking lot of the establishment.
