On July 11, 2012, the Troxel Company recalled about 100,500 Flexible Flyer Swing Sets in the United Sates. The manufacturer received 1,232 reports of the see saw seats breaking, which caused injuries to thirteen young children. The seats on the see saw can break away from the bolt fasteners during use causing the child to fall from the see saw.
The swing set comes in 11 different models, each with a see saw attachment. The swing sets were sold by Walmart, Toys R Us, Academy, other specialty stores and online retailers from December 2011 through May 2012 for between $130 and $280.
In May 2012, we also told you about another recall for a swing set made by Adventure Playsets. The reason for that recall was that the wood rotted and weakened the swing set causing a fall hazard. For that particular swing set, there was a similar recall back in November 2009.
Whether your swing set was recalled or not this year, you should always check the swing set before your children use it. Our children are not going to check the swing set for safety issues. It is up to parents to inspect the swing set to make sure there are no defects or fall hazards.
Unfortunately, even after checking a swing set, accidents can still happen due to design or manufacturing defects. In these situations, your child may be entitled to compensation because the swing set was a defective or dangerous product.
