September 16, 2010 - Philadelphia, PA - Famous Mexican Restaurant and Bar in Coatesville, P.A. was recently fined nearly $7 million by a Common Pleas Court jury for serving alcohol to an intoxicated man who later caused a serious car accident.
Pennsylvania has what is known as a "dram shop law" that allows victims of DUI accidents to seek restitution from the individual or establishment that is liable for a person's impairment and/or resultant DUI accident.
The Philadelphia Enquirer reported that Ryan Fell, 22, of Chester County sustained serious injuries from the accident that took place in 2007. She was recently awarded $6.8 million in damages.
The intoxicated man, Omar Villalava-Martinez, went to the Mexican restaurant and bar, where he reportedly consumed a dozen beers in 2 hours, in addition to a shot of liquor.
Police reports say that he departed from the bar around 9:30 p.m. and headed west on Route 30 in his Ford Explorer. He lost control of his vehicle in Sadsbury and crashed into Fell's Nissan.
Fell's attorney said that her client's car was crushed in the impact and as a result, she sustained severe accident injuries, mostly to her legs. Fell required 50 screws and metal plates to be inserted into her legs during surgery and she continues to suffer pain. She lost her administrative job as a result of her debilitating injuries and is currently not employed.
Villalava-Martinez was in the country illegally and was deported to Mexico. The restaurant involved in the lawsuit has since closed.
