The worst thing a lawyer can do for you right now is to tell you what you want to hear just to get you to hire them to represent you.
We see this all the time. Clients go to a lawyer’s office. The lawyer paints a very rosy picture of the case and tells them they are going to get a boat load of money at the end of the case.
Two or three years later, after all the work, effort and emotional investment go into the case, everything has changed. The sky is falling, and suddenly, the lawyer is pressuring the clients to settle the case for a fraction of what they were told the case was worth at the outset.
This process isn’t a game. This is your life and your future we are talking about. The reality is that not every accident that results in serious injuries should result in a lawsuit being filed.
It takes a very careful evaluation of both the liability portion of the case and the damages portion of the case before an informed decision can be made as to whether there should be a lawsuit filed.
This requires us to discuss with our prospective clients both the good parts of their case and the not so good parts of the case. That discussion often involves things that the clients really don’t want to hear. However, we feel that it is important to be as upfront and as honest with the client as we can be regarding the potential success of their case.
During the course of the case, we also meet periodically with our clients to update them and let them know how their case is going, i.e., whether it is going well or not so well.
Every lawsuit is a dynamic thing, it changes over time as depositions and other investigations are done throughout the course of the case.
We believe by keeping our clients informed of how their case is going throughout the course of the case with face to face meetings is the best way to ensure that there are no unpleasant surprises at the end of the case.
